Aggressive Representation of Motorcycle Accident Victims — Carlsbad Motorcycle Accident Lawyer

Motorcyclists enjoy the thrill of the open road, the fresh air rushing past, and the sense of freedom that only a motorcycle can provide.  In California, motorcycle riding has grown to be a beloved pastime, with over 800,000 registered motorcycles in the state.  California provides the ideal setting for motorcycle riding, with miles of open highway and scenic beach views.  Sadly, however, the number of motorcycle accidents has drastically risen as the popularity of these two wheel vehicles has increased.  Over four hundred individuals are killed throughout the state in motorcycle-related crashes each year.  California has the second highest number of motorcycle deaths in the U.S., behind only Florida.  Statistics show that most motorcycle accidents involve a collision with a passenger vehicle, and frequently it is the driver of the car that is at fault.

At Skolnick Law Group, Attorney Skolnick is committed to providing the victims of motorcycle accidents with superior legal services.  Our founding attorney, Suzanne Skolnick, created the Skolnick Law Group with one goal in mind—to obtain justice for the victims of all manner of accidents.  Those injured in motorcycle accidents require the assistance of an attorney with compassion, zeal, and an in-depth knowledge of the field.  Skolnick Law Group offers all these qualities and more.

The Devastating Results of California Motorcycle Accidents

After a dip in the number of California motorcycle accidents and deaths, crashes are unfortunately back on the rise.  Thousands of motorcycle riders sustain serious injuries throughout the state each year.  Due to the decreased protection afforded motorcycle riders, motorcycle accidents often involve serious injuries and losses.

Following a crash, a motorcycle accident victim and his or her family generally has the following categories of damages:

  • Serious injuries to the rider, including: traumatic brain injury; spinal cord injuries; severed limbs; disfigurement; internal organ damage; road rash; and paralysis.
  • Emergency room bills and possibly hospital admissions bills
  • Ambulance or helicopter bills
  • Damages to the motorcycle, helmet, and other bike equipment
  • Follow up physician bills and other medical expenses
  • Physical therapy bills
  • Lost wages
  • Future lost wages
  • Pain and suffering
  • Funeral expenses, when the accident results in death
  • Loss of companionship, when the accident results in death
  • Loss of wages of the primary breadwinner, when the accident results in death
  • Other damages, such as loss of consortium

As you can see from the list above, motorcycle accidents create a wide array of expenses to which injured motorcycle accident victims or their families may be entitled to compensation.  Accident victims can seek recovery of these damages and more through a personal injury or wrongful death claim.  A skilled motorcycle accident attorney can thoroughly assess your case and fight for you to obtain the best possible recovery.

Common Causes of Motorcycle Accidents in North San Diego County California

Motorcycle accidents can generally be attributed to one universal factor—the size differential between motorcycles and other vehicles.  This leads to accidents involving the failure of cars, trucks, and other motor vehicles to see the motorcyclist and avoid collision.  The following common accident scenarios occur due to this fundamental problem:

  1. Unsafe Lane Changes—occurring frequently on highways, but also on any multiple lane streets, the driver of the motor vehicle does not see the motorcyclist because he or she does not adequately check side view mirrors, rear view mirrors, and blind spots.  The driver changes lanes abruptly and collides with the motorcyclist.  Sometimes, the driver does not even use proper signals.  The motorcyclist has no opportunity to react and an accident ensues.  California Vehicle Code Section 22107 states that drivers must appropriately signal lane changes and can only move to the left or right when it is reasonably safe to do so.  Failure to abide by this basic driving law can lead to a finding of negligence on the part of the at fault driver.
  2. Left Hand Turns into Motorcyclists—often cited as the most common cause of motorcycle accidents, passenger vehicles frequently make a left hand turn and fail to see a motorcycle.  This causes a collision or may result in the motorcycle skidding to a halt.  Under California Vehicle Code Section 21801, the driver making a left hand turn must yield to the right of way of the motorcycle in such a scenario, and only start or continue turning when there exists a sufficient distance between the motor vehicle and biker.
  3. Motor Vehicles Pulling Out Into the Path of the Motorcycle—sometimes, a car, truck, or SUV fails to observe a motorcycle when pulling out of a side street, parking lot, or highway.  This can cause a broadside collision or force the biker to swerve and lose control.  California Vehicle Code Section 21804 requires all drivers entering roadways to yield the right of way to oncoming traffic, including motorcycles, and only enter when safe to do so.
